Does Fries tray without lid fall under the EWKFondsG?

Yes

Yes. Annex 1 EWKFondsG explicitly covers food containers "with or without a lid" — so an open fries tray falls under it just as much as a box with a lid.

Note: Since the UBA administrative regulation of Nov 3, 2025, a de-minimis threshold of 500g of packaged content applies: if the content exceeds this amount, the packaging no longer falls under the EWKFondsG. What counts is the content, not the weight of the packaging itself — and containers sold empty (e.g. empty salad bowls) are covered too.
